RESPONSIBILITIES:
This position is responsible for conducting workplace investigations related to employee misconduct, discrimination, harassment, and other policy violations. This role also manages the ADA interactive process, ensuring compliance with the Americans with Disabilities Act (ADA) and other applicable laws. Additionally, the position collaborates with legal counsel on investigation outcomes and ensures that HR policies align with legal and regulatory requirements.
This position reports to the Human Resources, EEO Counsel
TYPICAL TASKS:
- Conducts thorough, impartial, and confidential investigations into employee complaints, workplace misconduct, discrimination, harassment, and other policy violations.
- Gathers and analyzes evidence, interview witnesses, and document findings in comprehensive investigation reports.
- Works closely with legal counsel to ensure compliance with employment laws and regulations.
- Provides recommendations for corrective actions or disciplinary measures based on investigation findings.
- Maintains detailed, accurate records of investigations in accordance with organizational policies and legal requirements
- Facilitates the ADA interactive process with employees requesting workplace accommodations.
- Engages in discussions with employees, supervisors, and medical professionals to determine reasonable accommodations.
- Ensures compliance with federal, state, and local disability laws, including the Americans with Disabilities Act (ADA) and Rehabilitation Act.
- Documents accommodation requests, decisions, and any alternative solutions offered.
- Provides training and guidance to managers and employees on ADA compliance and workplace accommodations.
- Serves as the HR liaison with legal counsel regarding investigation outcomes and ADA compliance issues.
- Assists in responding to EEOC complaints, legal claims, and audits related to workplace investigations and ADA accommodations.
- Ensures HR policies and procedures align with legal standards and best practices.
- Provides recommendations for policy improvements based on investigation trends and compliance needs.
- Performs related work as assigned.
KNOWLEDGES, SKILLS AND ABILITIES:

- Strong knowledge of employment laws (Title VII, ADA, FMLA(Family and Medical Leave Act), FLSA(Fair Labor Standards Act), EEOC(Equal Employment Opportunity Commission) regulations, etc.).
- Experience conducting sensitive workplace investigations with confidentiality and neutrality.
- Ability to analyze complex situations and provide legally sound HR recommendations.
- Strong written and verbal communication skills for documenting investigations and reporting findings.
- High ethical standards and attention to detail.
- Ability to handle highly confidential and sensitive information with discretion.
EDUCATION AND EXPERIENCE:
- JD degree, and member in good standing with the North Carolina State Bar.
- Minimum of 4 years of experience in employment law or conducting workplace investigations, handling ADA accommodations in a HR or legal setting
PREFERRED
- Professional in Human Resources (PHR) or Senior Professional in Human Resources (SPHR)
- Association of Workplace Investigators (AWI) Training Certificate
- ADA Coordinator Training Certification
